Convicted felon transgender illegal immigrant wins case against deportation


A California court of appeals has ruled that convicted felon transgender illegal immigrant Edin Carey Avendano-Hernandez cannot be deported from the United States to Mexico.

"Country conditions evidence shows that police specifically target the transgender community for extortion and sexual favors and that Mexico suffers from an epidemic of unsolved violent crimes against transgender persons.

"Avendano-Hernandez, who takes female hormones and dresses as a woman, is therefore a conspicuous target for harassment and abuse," Judge Jacqueline Nguyen wrote for the 9th Circuit panel in the 20-page ruling.

Avendano-Hernandez was twice convicted of driving under the influence in 2006. He was deported from the United States after the second felony offence, since another driver sustained injuries during an accident with Avendano-Hernandez.
