Justice Breyer Defends Justice Thomas

Should Justice Clarence Thomas recuse himself from all potential proceedings on the Constitutionality of ObamaCare because of his wife's affiliation with Tea Party associated organizations last year, which she financially benefited from?

Most conservatives say absolutely not, while liberals have launched campaigns demanding his recusal. But what about a fellow member of the United States Supreme Court - from the other side - on whether the Justice should sit out this fundamentally important case?

According to Justice Stephen Breyer, who is one of the four liberals on the court, "this is a false issue" that does not hold water because the action of your spouse, an independent person, has nothing to do with your work on the court. He pointed to his wife's work in psychology and his own involvement in related cases as an example.

There you have it - Justice Breyer has just confirmed what Conservatives have said for months now - the actions of Mrs. Thomas do not, in any possible way, impact the impartiality of Justice Thomas and the same applies to every Justice.

  1. How is it that this even became an issue when Sotomeyer's past statements and affiliations didn't stand in the way of her being appointed to SCOTUS?
